Reactivation or Reinstatement Application
An individual with a lapsed license must submit a reactivation / reinstatement application.
If a license has been suspended or revoked by the NM Board of Nursing as a consequence of discipline all conditions must be met by the individual. If the revocation was indefinite, a lift of revocation must be petitioned of the Board of Nursing before the reinstatement process can be completed. If you are requesting to petition the Board for the reinstatement of your license/certificate, please complete the form below to submit your request to the Executive Director.
For individuals who have not held an active nursing license in any U.S. State or Territory in 4 or more years must complete a refresher course per 16.12.2.10.R(7) NMAC.
Application Process
To reactivate/reinstate your license online, use the Reinstatement Application.
An attestation of an expired license (ELA) must be submitted within 5 days of submission of the reactivation/reinstatement application. Lactation Care Providers are not required to submit an ELA form as part of the reactivation/reinstatement process. The ELA shall be completed, scanned and uploaded in your Nurse Portal Account. https://nmbn.boardsofnursing.org/nmbn.
You are required to meet the requirement for to reactive a license. The continuing education must be completed within the previous 24 months from the date of application. Proof of this is must be submitted to CE Broker (link to free CE Broker account). If you are reactivating/reinstating a LPN or RN license and desire a multistate (Compact) license, you must complete a Criminal Background Check. Proof of your primary state of residence and your social security number must also be provided. They can be scanned and uploaded in your Nurse Portal Account.
Rules Regarding Reactivation and Reinstatement
16.12.2.7 DEFINITIONS:
R. Definitions beginning with the letter R:
(1) “reactivation”, the process of making current a license which has been in abeyance as a result of failure to comply with the necessary renewal requirements; this process does not involve board action at any juncture;
(4) “reinstatement”, the process whereby a license which has been subject to revocation or suspension, is returned to its former status by individual board action; this process always involves board action, and requires filing of a form and payment of the reinstatement fee;

16.12.1.9 DISCIPLINARY ACTION:
J. Reinstatement of license or certificate.
(1) individuals who request reinstatement of their license or certificate or who request that their probation be lifted must be prepared to provide the board with evidence to support their request. This evidence may be in the form of written reports or verbal testimony from individuals who have knowledge of the licensee’s or certificate holder’s activities and progress during the period of probation, suspension or revocation;
(2) requests for reinstatement of a revoked license or certificate shall not be considered by the board prior to the expiration of one year from the date of the order of revocation, unless provided for in the order of revocation. The date at which time the board chairman’s signature is affixed to the order of revocation or suspension is the controlling date, unless otherwise specified in the order;
(3) requests for reinstatement of a suspended license or certificate shall be considered at such time as provided by the board in the order of suspension;
(4) reinstatement of a revoked or suspended license requires proof of meeting the renewal requirements as set forth in these rules adopted by the board, and payment of the reinstatement of current or lapsed license fee.

16.12.2.10 LICENSURE REQUIREMENTS FOR REGISTERED AND PRACTICAL NURSES:
R. Requirements for relicensure and reactivation. Applicants for relicensure and reactivation must meet CE requirements as stated in these rules, pursuant to the Nursing Practice Act Section 61-3-24 NMSA 1978. The CE may be prorated to commensurate with the length of the renewal period.
(7) Individuals who are reactivating a license which has been lapsed for four or more years must complete a refresher course that includes both a didactic and clinical component designed to prepare a nurse who has been out of practice to re-enter into practice.
(a) Applicants will follow the criminal background check process required by the New Mexico department of public safety or its agent and have a new criminal background check result approved.
(b) A temporary license will be issued not to exceed six months unless the board of nursing approves an extension to allow the individual to complete the refresher course clinical component. If documentation is not received by the board verifying successful completion of the refresher course prior to the temporary license expiration date, the individual will not be allowed to practice nursing.
(c) Advanced practice nurses who are reactivating an advanced practice license which has been lapsed for four or more years must also complete a refresher course or certification reactivation that is reflective of their specific advanced practice knowledge, skills and expertise. A temporary license will be issued not to exceed one year unless board of nursing approves an extension.

Reinstatement Request Form
Pursuant to 16.12.1.9.J NMAC and 16.12.11.14 NMAC individuals have the right to petition the Board for reinstatement of their license or certificate after a disciplinary action by the Board. If your license is inactive or lapsed for any reason than other than a disciplinary action by the Board, you do not need to complete this form. The form below begins the formal request process. All responses are forwarded to the Executive Director of the agency.
