The mission of the New Mexico Board of Nursing is to protect the public safety through effective regulation of nursing care and services. One way the Board accomplishes this is by receiving complaints and disciplining licensees and certificate holders who violate the law and rules.
DISCIPLINARY ACTIONS
The board conducts hearings to determine if a violation of the Nursing Practice Act or the Board of Nursing rules has occurred and the appropriate level of discipline to impose. The Board has two investigators and an administrative prosecutor to investigate complaints and prepare cases for hearing before the Board.
Disciplinary Actions will show you summaries of past disciplinary actions taken by the board.
HOW TO FILE A COMPLAINT
A complaint must be against a person licensed or certified by the board
The Board licenses or certifies:
- Licensed Practical Nurses
- Registered Nurses
- Nurse Practitioners
- Clinical Nurse Specialist
- Certified Registered Nurse Anesthetists
- Certified Hemodialysis Technicians
- Certified Medication Aides
- Licensed Lactation Care Providers
The Board DOES NOT regulate Certified Nursing Assistants or other healthcare professionals.
Grounds for discipline against a licensee are set out in the board rules (NMAC 16.12.1.9).
Anyone may file a complaint
Anyone with knowledge of a violation of rule or law by a person licensed or certified by the board may file a complaint. The Board will not consider anonymous complaints. The person making the complaint must provide accurate contact information so that the information submitted in the complaint can be verified.
Nurses are required by Board rule to report violations of the Nursing Practice Act and accompanying rules.
Submitting a complaint:
- Submit your complaint through the Complaint Portal.
- Provide specific information about the time and place of any incident reported.
- You will need to provide a detailed statement describing the facts related to the alleged violation.
- Before starting a complaint, make sure you have all the information available.
- You will have to complete the complaint submission in one session.
- You will not be able to save your progress.
- You will have the opportunity to submit documents electronically. You are allowed to upload only the following file types: txt, .doc, .docx, .xls, .xlsx, .jpg, .jpeg, .gif, .png , .tif, .tiff, .pps, .ppt, .pdf, .mp3, .wav, .avi, .mpg, .mpeg, .wmv, .mov, .flv, .mp4 files.
